Article 3: Offer

The Customer can choose between the following payment methods:

PERDU has the right to refuse an order or subject it to additional conditions due to a serious failure by the customer with regard to orders in which the customer is involved, an incomplete ordering procedure, orders by minors, large orders or problems with previous orders, and so forth.

Article 5: Delivery and execution of the agreement

The delivery times stated by PERDU are approximate and are not strict deadlines. Unless otherwise agreed or expressly stated otherwise, the goods will be delivered to the customer's place of residence within 30 days of receipt of the order.

If you have ordered an item that is temporarily out of stock, you will be indicated when the product will be available again. As soon as the items to be delivered have been delivered to the specified delivery address, the risk regarding these products passes to the buyer.

Different conditions may apply to deliveries abroad.

PERDU usually delivers all over the world. If an order cannot be delivered to the destination country, the customer will be informed and PERDU reserves the right to cancel the order.

Delivery takes place exclusively by courier service, unless otherwise agreed prior to the agreement.

The delivery or shipping costs will be communicated to you before confirming your purchase. If shipping costs cannot be calculated automatically, they will be itemized and/or an indication of shipping costs will be given.

Any visible damage and/or qualitative shortcomings of an item or any other shortcoming in the delivery must be reported immediately to PERDU by the Customer.

The risk of loss or damage passes to the Customer once he (or a third party other than the carrier and designated by the Customer) has acquired physical possession of the goods.

Article 6: Retention of title

The delivered items remain the exclusive property of PERDU until full payment by the Customer.

The Customer undertakes, if necessary, to inform third parties of PERDU's retention of title, for example to anyone who intends to seize items that have not yet been fully paid for.

Article 7: Right of withdrawal

The provisions of this article only apply to customers who purchase products online from PERDU in their capacity as consumers.

The Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days after the day on which the customer or a third party other than the carrier and indicated by the customer acquires physical possession of the goods.

To exercise the right of withdrawal, the customer must inform PERDU of his decision to cancel the contract by means of an unequivocal statement by email to hello@perdu.business.

To comply with the withdrawal period, the customer must send his/her notification of the exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to PERDU without delay, but in any case within 14 calendar days after the day on which he informed PERDU of his decision to terminate the agreement. The customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs for returning the goods are borne by the customer.

If the returned product has somehow lost part of its value, PERDU reserves the right to hold the customer liable and claim compensation for any lost value of the goods as a result of the use of the goods by the customer who goes beyond what is necessary to determine the nature, characteristics and operation of the goods.

Only unused items in their original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be returned.

If the customer withdraws from the agreement, PERDU will refund all payments received from the customer to date, including standard delivery costs, within a maximum of 14 calendar days after PERDU has been informed of the customer's decision to withdraw from the agreement. revoked. In the case of sales contracts, PERDU may postpone the refund until it has received all the goods back, or until the customer has proven that he has returned the goods, whichever comes first.

Any additional costs resulting from the choice of a delivery method other than the cheapest standard delivery offered by PERDU will not be refunded.

PERDU will reimburse the customer with the same payment instrument with which the customer carried out the original transaction, unless the customer has expressly agreed otherwise; in any case, no costs will be charged for such a refund.

The Customer cannot exercise the right of withdrawal for:

  • the supply of goods manufactured to the customer's specifications, or which are clearly intended for a specific person (including personalized items or customization)
  • the delivery of goods that spoil quickly or have a limited shelf life;
  • the supply of alcoholic beverages, the price of which was agreed upon when the sales contract was concluded, but the delivery of which can only take place after 30 days and whose actual value depends on market fluctuations beyond the control of the company;

Article 8: Warranty

In accordance with the Belgian law of 21 September 2004 on the protection of consumers when selling consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the customer must provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the customer, the customer must contact PERDU Customer Service (hello@perdu.business) and return the item to PERDU at their own expense.

If a defect is found, the customer must inform PERDU as soon as possible. In any case, any defect must be reported by the Customer within 2 months of discovery. Any right to repair or replacement expires after this period.

The (commercial and/or legal) warranty never applies to defects arising as a result of accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, non-compliance with the manual or instructions for use , modifications or adjustments to the item, heavy-handed use, poor maintenance or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months after the date of purchase, or delivery if applicable, are deemed not to be hidden defects, unless the customer can prove the contrary.

Article 10: Sanctions for non-payment

Without prejudice to the exercise of other rights available to PERDU, in the event of non-payment or late payment from the date of breach of contract, the Customer is liable to pay statutory interest of 10% on the unpaid amount automatically and without further notice. In addition, the Customer owes a fixed compensation of 10% on the relevant amount, with a minimum of 25 euros per invoice by operation of law and without further notice of default.
